    It is not an ammendment to the constitution but an act created by congress. Unlike a ammendment (which requires state ratification) an act only requires approval from both the House and Senate and then to be signed into law by the President. It is an ‘act’ of congress not an ammendment to the constitution but the constitution does provide for congress to pass such ‘acts and rulings’.
